Trademark Usage Policy

Introduction
This Trademark Usage Policy (“Policy”) provides guidelines for Ushio America, Inc.’s (“Ushio”) authorized resellers, licensees, consumers, and other third parties (“you”) seeking to use Ushio’s trademarks. If you have an agreement or contract with Ushio, you may also be subject to additional restrictions.
For the purposes of this Policy, such trademarks include (collectively, the “Trademarks”):

Ushio
Ushio America, Inc.

The Trademarks are valuable assets of our company and must be used properly. By using one or more of the Trademarks, you agree (i) that Ushio and/or its related entities are the sole and exclusive owner of the Trademarks, (ii) to not interfere with, challenge, or object to Ushio’s rights in the Trademarks, (iii) the goodwill derived from any and all use of the Trademarks inures solely to Ushio’s benefit, and (iv) that you will comply with the terms of this Policy as stated and as revised.

Ushio reserves the right, at any time and in its sole discretion, to modify or revise the terms of this Policy and/or revoke its approval of your use of the Trademarks. Except for the limited right to use the Trademarks as permitted under this Policy, no other rights of any kind are granted hereunder.

Use of the Trademarks
With Ushio’s express written permission, you may only use the Trademarks on product packaging or advertising copy to describe that your product features Ushio’s Care222 technology. If your product does not feature Ushio’s Care222 technology, you cannot use the Trademarks. The following guidelines apply to the authorized use of the Trademarks:

  • The Trademarks should be introduced with a referential phrase, such as “featuring” or “built with.” For example, “[Your Product Name] Featuring Ushio’s CARE222® technology.”
  • Within close proximity to the first use of the Care222 mark or the Care222 Logo, Ushio’s ownership of such technology should be referenced.
  • The Care222 trademarks should always be used as an adjective, preceding an appropriate noun (i.e., technology or lamps).
  • The Trademarks cannot be part of your company name, business name, product name, trademark, service mark, domain name, or social media name, handle, or profile.
  • The Trademarks should not be used in any way that is false or misleading, or may cause confusion about the affiliation between you and your products and Ushio or Ushio’s products.
  • The Trademarks cannot be modified or altered in any way, including but not limited to, by combining the Trademarks with any of your branding elements or changing the capitalization.
  • Each representation of the Trademarks should be clear and undistorted.
  • Proper trademark marking must be used at all times, and if space permits, you should include an attribution to Ushio’s ownership of the Trademarks:

The Care222 standard character mark and stylized logo mark are registered trademarks of Ushio America, Inc., in the United States, European Union, and United Kingdom.

Distribution in Other Countries:
The Care222 standard character mark and stylized logo mark are trademarks of Ushio America, Inc.
Ushio and Worldwide ®The Ushio standard character mark and stylized logo mark are trademarks of Ushio Denki Kabushiki Kaisha or Ushio America, Inc., registered in more than 40 jurisdictions worldwide.
  • You may not use the Trademarks in a disparaging, objectionable, or illegal manner as determined solely by Ushio.
  • You may not use the Trademarks in connection with any products that do not meet Ushio’s high quality standards.

Ushio reserves the right to request samples of your use or proposed use of the Trademarks on product packaging and advertising or promotions. Ushio reserves the right to request changes to such use of the Trademarks or to demand that you cease all use of the Trademarks. You agree to promptly cooperate with all such requests by Ushio.
